Terms of service

Agreement to these terms

These terms govern your use of Kelp: the Mac app, the cloud processing and hosting service, and the website at kelp.md, operated by Aaron Delasy (“the operator”, “we” or “us”). By signing in to or using Kelp, you agree to these terms. The Privacy policy explains how we handle your information.

The service

Kelp turns a screen walkthrough, your voice and annotations into one Kelp link with a kelp.md brief and hosted screenshots that coding agents can read. You use the Mac app and its cloud processing and hosting service, operated by Aaron Delasy. You must be 18 or older to use Kelp.

Your account

You can sign in with GitHub, Google or an emailed magic link. Keep access to your sign in provider and email under your control, provide accurate account information, and contact the operator if someone else gains access to your account. Signing in with GitHub or Google is also subject to that provider’s terms.

Acceptable use

You are responsible for what your screen and microphone capture and what you share. Do not record other people’s private information without their consent. Use Kelp lawfully, respect other people’s rights, and do not use it to distribute unlawful content or malware. Do not try to access other people’s accounts or Kelps, get around plan limits or security measures, or overload or disrupt the service.

Your content

You retain your content. You give the operator permission to process it, produce your brief and host your files to provide the service you request, including serving them to anyone with the link. That permission follows the deletion and public link limits in these terms and the Privacy policy. It is not permission to sell your content, use it in advertising or train models on it. You are responsible for having the rights and permissions needed for what you record and share.

Public links

Anyone with a Kelp link on v.kelp.md, or a file link on cdn.kelp.md, can open it without signing in and can download, copy and forward the video, screenshots, brief, kelp.json and transcript.json. Coding agents, AI tools and other automated clients that you or a recipient give the link to can fetch it. Random links, robots rules and requests not to index, archive or train on a Kelp are not access control and do not make it private. Choose what you capture and share with that in mind. Deleting a Kelp stops its link from working, but Kelp cannot erase copies already made by recipients, their agents or the providers of those tools.

Plans and limits

Free includes one hour of recording per rolling seven days, with any number of Kelps. Each can last up to five minutes within your remaining budget. Trial, Pro and founder plans allow up to thirty minutes per Kelp with no recording time cap, subject to fair use of a shared service. The trial starts when you create your Kelp account and lasts fourteen days.

On Free, hosted media is scheduled to expire thirty days after the recording is created, and a bounded daily cleanup removes it, so removal can happen later. Expiry keeps kelp.md, kelp.json, transcript.json and relevant brief and usage metadata. Recordings created while you are on Trial, Pro or founder have no scheduled media expiry, subject to deletion and service availability. Starting a trial does not remove expiry already scheduled on earlier Free recordings, and expired files are not restored.

Free briefs include the Sent with Kelp footer. Trial, Pro and founder plans can turn it off. Pro is not yet purchasable.

AI output

AI output is not guaranteed to be correct or complete. Review your brief before sharing it, and review and test changes made by your coding agent. You decide whether the output is suitable for your work.

Availability during alpha

Kelp is an alpha service. Features may change and processing, storage and availability are not guaranteed. Keep copies of content you need and allow for interruptions or errors.

Termination and deletion

You may stop using Kelp at any time, delete individual Kelps in the app and contact the operator about your account. The operator may restrict or end access for unlawful use or misuse of the service, subject to applicable law.

Deleting a Kelp removes its hosted files, hides it and stops its link from working. Its brief text, title and metadata stay hidden in the database until a bounded daily cleanup permanently removes deleted records after at least thirty days, with no promise of an exact day. Cached media can remain reachable for up to about an hour. Your local files and copies held by other people, their agents or other services are not erased. To delete your account or get a copy of your information, email hello@kelp.md. See the Privacy policy for the difference between media expiry and deletion.

Liability

These terms limit responsibility for loss caused by unavailable or incorrect alpha service only as far as applicable law permits. Nothing in these terms limits liability for intentional breach, for harm to life or health, or for rights that applicable law, including consumer protection law, does not allow to be waived.

Governing law

These terms are governed by the law of Ukraine. Disputes about these terms or Kelp are decided by the courts of Ukraine that have jurisdiction under Ukrainian law. This does not limit any mandatory right you have to bring a claim where you live, or to rely on protections of the law where you live that cannot be excluded by agreement.

Changes to these terms

We will update the date above when these terms change. For a material change, we will take reasonable steps to tell you before it takes effect, for example by email. If you do not agree, you can stop using Kelp and delete your Kelps.
